Canada is upset that Washington special-interest groups are thwarting the Keystone XL pipeline, Canadian Foreign Minister John Baird told The Cable, forcing the country to move forward to find other customers for its oil.

"There's a great deal of frustration, less with the administration and more that the future prosperity of our country could lie in the hands of some radical environmentalists and special interests," Baird said in a Thursday interview in Washington. "That causes us great concern, so we want to look to diversify our markets, whether that be with Japan, Korea, or China, which has expressed a great interest."

U.S. President Barack Obama rejected TransCanada's permit application to build the pipeline in January after being compelled to issue a quick decision on the application by congressional legislation. He had received pressure from environmental groups, which had organized protests around the country opposing the construction of the pipeline.

No decision is expected on the pipeline this year, although Obama did announce last month that he intends to approve the southern piece of the pipeline soon. On Wednesday, Nebraska lawmakers passed a bill to re-launch a review of the pipeline route.

But Ottawa isn't waiting around for the United States to make a decision. The Canadia government is proceeding to build its "Northern Gateway" pipeline that would end in British Columbia, where the oil could be shipped directly to East Asia.

"It was certainly driven home to the energy sector in Canada that being captive to a special interest can have huge consequences on the future prosperity of our country. That's certainly known and accepted in a way that it wasn't last fall," Baird said.

Canada also knows how to deal with environmental groups, said Baird. The Canadian government has eliminated environmental impact studies for 90 percent of projects and has sped up the approval process, he said.

According to Baird, the United States is losing jobs due to the delay of the pipeline approval in Washington. But in a way, Canada stands to benefit from the impasse.

"Oil sands oil currently sells at a discount because we are a captive market, and if we could diversify that market, that discount could end," said Baird.

"If you look at all the oil around the world, there's precious little of it that is found in stable economies and stable democracies, and we want to share that resource with our closest partner," he said. "We're going to work hard to see the project approved, hopefully early next year."

Baird came to Washington for the G-8 foreign minister's meeting, which focused on the crises in Iran, North Korea, and Syria. Canada supports humanitarian and medical aid to the Syrian people but not arms for the Syrian opposition, Baird said. He also said there's no talk right now within NATO about establishing buffer zones inside Syria using NATO assets.

After Syrian troops fired over the Turkish border this week, Turkish Prime Minister Recep Tayyip Erdogan suggested that Turkey might invoke NATO Article 5, which provides for common defense of any threatened NATO country. Baird said the red line was if Syrian troops actually enter Turkey.

"There will be strong international support for Turkey if Syrian forces cross the border," he said.  "Canada is a member of NATO, and if Syria wants to conduct military operations in a NATO country, they will get a strong reaction."

He didn't clarify what that strong reaction might entail.

Baird also shared news of a bet he made Thursday with Secretary of State Hillary Clinton over the NHL playoff series between the Ottawa Senators and the New York Rangers. If the Senators win, Clinton must wear their jersey. If the Rangers win, Baird will sport a Rangers sweater.

"After the Ottawa Senators win, she'll look great in red," he said, noting that in Canada, unlike in the United States, red is the liberal color.

Thirty-seven Republican senators have co-sponsored a new bill aimed at forcing the Obama administration to move forward with the Keystone XL U.S.-Canada oil pipeline project.

"Jobs will be created right away and billions of dollars in investment will be unleashed through legislation introduced to permit the $7 billion Keystone XL pipeline, the largest infrastructure project ready in the United States, to commence construction," said Sen. Dick Lugar (R-IN), the lead sponsor of the "North American Energy Security Act," introduced Wednesday, in a release. "This is no time for delay."

Lugar is leading the drive to move the project forward along with Sens. John Hoeven (R-ND) and David Vitter (R-LA).

The White House announced a delay in moving forward with the project on Nov. 10, saying that it needed time to explore alternative routes for the pipeline, which would bring crude oil from Canadian oil sands deposits to refineries in the southern United States. The delay announcement came right in the middle of the State Department's own review of the project. In a statement, State said it was particularly sensitive to concerns about running the pipeline through the environmentally sensitive Sand Hills region of Nebraska.

The main builder of the pipeline, TransCanada Keystone Pipeline, LP, applied for a permit to build the pipeline in 2008. The State Department is in charge of doing the Environmental Impact Study on the project, but has been criticized for outsourcing that work to a company called Cardno Entrix, which has deep financial ties to TransCanada.

Despite that, the pipeline's environmental impact review is ongoing, and the 37 GOP senators want the permit issued within the next 60 days. They are accusing the White House of delaying the project for political reasons.

"President Obama has the opportunity of creating 20,000 new jobs NOW. Incredibly, he has delayed a decision until after the 2012 election apparently in fear of offending a part of his political base and even risking the ire of construction unions who support the pipeline," Lugar said.

Specifically, the bill would require the Secretary of State to issue the permit within 60 days unless the president determines it is not in the national interest. The legislation would also require the permit to contain provisions for environmental protection and would specify that the state of Nebraska would have the right to make sure the pipeline route does not impact the Sands Hills area.

Lugar is promising to press for quick consideration of the bill in the Senate Foreign Relations Committee.

The wide-ranging sanctions law passed by Congress and signed into law by President Barack Obama last July calls for the administration to punish companies from third-party countries that are still doing business in Iran. However, U.S. senators still aren't sure whether the administration will follow through with this punishment, especially when it comes to companies in China.

A bipartisan group of 10 U.S. senators, led by Sens. Jon Kyl (R-KY) and Robert Menendez (D-NJ), wrote to Secretary of State Hillary Clinton on Thursday to demand an update on the State Department's investigation into these companies' ongoing business with the Iranian regime. Their letter was subsequently obtained by The Cable. Deputy Secretary of State James Steinberg announced that State's investigation began on Sept. 29, which means that law requires the results to arrive by March 29, the senators wrote.

"It appears that Chinese firms in the energy and banking sectors have conducted significant activity in violation of U.S. law," the senators stated. "We cannot afford to create the impression that China will be given free rein to conduct economic activity in Iran when more responsible nations have chosen to follow the course we have asked of them. We are sure you agree."

The State Department's Bob Einhorn is briefing senators on Capitol Hill on this very issue on Friday, a senior GOP Senate aide told The Cable.

In remarks at the Carnegie Endowment for International Peace on Wednesday, Einhorn addressed the issue directly, saying that "we continue to have concerns about the transfer of proliferation-sensitive equipment and materials to Iran by Chinese companies, there is substantial evidence that Beijing has taken a cautious, go-slow approach toward its energy cooperation with Iran."

That explanation won't be enough to satisfy the senators' demands for more active confrontation if Chinese companies are indeed flouting sanctions.

One of the main concerns on Capitol Hill is that as countries pull out from Iran, other countries will take over contracts, thereby nullifying the effect of the sanctions -- a practice known as "backfilling."

For example, the administration and Congress worked hard to convince Japan and South Korea to impose unilateral measures against Iran. However, there's particular concern that China firms will simply come in and take over those contracts.

Kyl and Sen. Chuck Schumer (D-NY) sent a letter to Clinton last October on this very issue, noting reports that China National Petroleum Company (CNPC) replaced the Japanese firm Inpex and agreed to invest around $2 billion to develop Iran's South Azadegan oil fields last year.

One week later, the Government Accountability Office (GAO) released a report that identified 16 companies that sold petroleum products to Iran between Jan. 1, 2009, and June 30, 2010. Of those 16, the GAO reported that five have shown no signs of curtailing business with Iran. Three of those companies are based in China, one in Singapore, and one in the UAE.

Other lawmakers who have pressed the administration to enforce Iran sanctions against China include Sens. Joe Lieberman (I-CT), Susan Collins (R-ME), Mark Kirk (R-IL), and Rep. Howard Berman (D-CA).

"Clearly, Congress -- on both sides of the aisle -- is losing patience and expects the administration to act," said Josh Block, a senior fellow at the Progressive Policy Institute and former spokesman for AIPAC. "If not, what kind of message are we sending to these companies in China and Venezuela and Turkey and elsewhere -- and their governments -- that are helping Iran break international isolation?"

The common perception on Capitol Hill is that China is not doing its part to support the international community's drive to halt Iran's emerging nuclear program. Not so, two senior administration officials said on Wednesday, as they praised China's action on Iran in a conference call with reporters on President Hu Jintao's visit to Washington.

The Chinese have stopped new investments in Iran's energy sector, improved their controls over weapons technology exports to Iran, and Chinese state-owned corporations are not backfilling business opportunities left open by other countries that are leaving Iran, the senior administration officials said. The officials also explained that the Iran issue has been at the top of the agenda on the U.S.-China relationship and that's partly why Beijing's behavior on Iran has improved.

"In all the meetings between the president and President Hu and our high-level interactions, there was no issue that occupied as much time and attention as Iran. It was absolutely at the top of the agenda in pretty much every meeting," one of the senior administration officials said, explaining that recent Chinese action vis-à-vis Iran "demonstrates positive results of that focus."

One of the top concerns in Congress right now about the U.S.-China relationship is that Beijing is not enforcing international arms sanctions against Iran and that Chinese companies have not stopped doing business with Iran's energy sector. Last week, two leading senators wrote to President Barack Obama warning that if the administration doesn't enforce U.S. sanctions law on Chinese companies, Congress will act.

"In fact, in the last seven months since the passage of the resolution I'm not aware of any new Chinese investments in the energy sector," another senior administration official said, apparently not counting ongoing deals between China and Iran to develop gas fields as "new". "That's an important development and it's an important signal to Iran."

"You do not see the kind of backfilling that might undercut the sanctions regime," the first official said.

Regarding exports of missile technology to Iran, one of the officials said that China "essentially adhere[s] to the guidelines of the Missile Technology Control Regime," which is meant to stop sensitive weapons transfers, despite the fact that China is not a member of that regime.

"China has done a great deal to improve its export control regime in order to try to block such exports," the official said. "There are gaps in China's enforcement. China's enforcement is still problematic... We don't see that as willful action by the Chinese government but as gaps in their system, which we urge them to correct."

In October, the Washington Post reported that U.S. officials had given the Chinese government a list of Chinese companies believed to be breaking international sanctions on arms transfers, including by giving them technology to help their missile and nuclear programs.

Both officials also touted Chinese support for U.N. Security Council resolution 1929, which one official described as "much stronger sanctions than anyone anticipated would pass, or that China would sign on to."

The senators don't agree that the Chinese government is willingly moving to end those abuses and in their letter, they cited numerous reports that China is supplying crucial materials to aid Iran's nuclear and missile programs and alleged that Beijing continues to give monetary and material support to Iran's energy sector, including the delivery of refined petroleum products, which does not violate U.N. sanctions but could provoke penalties under U.S. laws passed by Congress, including the Comprehensive Iran Sanctions Accountability and Divestment Act that Obama signed into law in July, 2010.

The senators specifically named the state-owned China National Petroleum Corporation (CNPC) and the China Petroleum and Chemical Corporation (SINOPEC) as firms that could be subject to U.S. penalties.

"We urge you to warn President Hu that the U.S. will be forced to sanction these companies if they do not quickly suspend their ties with Iran," the senators wrote.

Last October, the Government Accountability Office (GAO) released a new report that identified 16 companies as having sold petroleum products to Iran between Jan. 1, 2009, and June 30, 2010. Of those 16, the GAO reported that five have shown no signs of curtailing business with Iran. Three of those companies are based in China, one in Singapore, and one in the UAE.

But the joint statement issued on Wednesday by Obama and Hu made no mention of the U.S. sanctions law that could result in congressionally imposed penalties on Chinese companies. Here's the totality of what it said on Iran:

On the Iranian nuclear issue, the United States and China reiterated their commitment to seeking a comprehensive and long-term solution that would restore international confidence in the exclusively peaceful nature of Iran's nuclear program.  Both sides agreed that Iran has the right to peaceful uses of nuclear energy under the Non-Proliferation Treaty and that Iran should fulfill its due international obligations under that treaty.  Both sides called for full implementation of all relevant UN Security Council Resolutions. The United States and China welcomed and will actively participate in the P5+1 process with Iran, and stressed the importance of all parties - including Iran - committing to a constructive dialogue process.  

UPDATE: A senior GOP Senate aide responds to the administration officials' comments with considerable skepticism:

"These senior Administration officials continue to obfuscate and misdirect. Chinese entities are clearly in violation of the Iran, North Korea, and Syria Nonproliferation Act (INKSNA) and the Comprehensive Iran Sanction, Accountability, and Divestment Act of 2010 (CISADA)," the aide said. "If the administration doesn't act soon, it faces the loss of its waiver authority and investigatory discretion on these matters."

Top Obama administration officials Thursday lauded Iraq's latest efforts to form new government and defended their intensive efforts to help push through the deal, even though their proposal was very different from the agreement that it appears Iraqi leaders have reached.

"We've worked very hard in recent months with the Iraqis to achieve one basic result, and that's a government that's inclusive, that reflects the results of the elections, that includes all the major blocs representing Iraq's ethnic and sectarian groups, and that does not exclude or marginalize anyone," a senior administration official told reporters on a conference call Thursday afternoon. "And that's exactly what the Iraqis seem to have agreed to do."

The White House and the State Department have been walking a very fine line when talking about their involvement in Iraqi political negotiations. The administration has often stated that it does not seek to impose any specific solution on the Iraqis, but at the same time has been working behind the scenes on behalf of former Prime Minister Ayad Allawi's Iraqiya coalition, which received the most seats in Iraq's March parliamentary elections, but not enough to form a government on its own.

The United States has a direct interest in maintaining whatever influence it can in Baghdad as U.S. troops leave Iraq, in a bid to counter Iranian attempts to push Iraqi politics toward a more Shiite and religious bent. That's a tricky balancing act for the White House, which wants to claim credit for its involvement while simultaneously appearing neutral and keeping the responsibility of deal making in the hands of Iraqi politicians. The still-evolving agreement between all of Iraq's major political players would keep Prime Minister Nouri al-Maliki and President Jalal Talabani in their posts, while allotting Allawi's Iraqiya slate the position of Speaker of the Parliament and the chairmanship of a new National Council on Strategic Policies. Saleh al-Mutlak, one of Iraqiya's most prominent figures, is also being floated as a potential foreign minister in the new unity government.

The New York Times reported Thursday afternoon that Allawi's slate walked out of Thursday's parliamentary session after failing to score a vote on a series of demands. But if the Iraqi politicians are successful in ironing out the details and forming their government, the Obama administration stands ready to endorse the deal. However, it doesn't want the credit for brokering the agreement.

"The most important thing about what happened in Baghdad today is that this is a government that is made in Iraq," the official said. "It was not the result of the influence or work of any outside actor, any outside country. The decisions that the Iraqis reached, they reached themselves. They negotiated very difficult issues themselves, and they came to an agreement."

In fact, however, top administration officials were deeply involved in the negotiations, especially toward the very end. The official spoke of personal efforts by Obama, Vice President Joseph Biden, Secretary of State Hillary Clinton, U.S. Ambassador Jim Jeffries and others. In recent days, Obama spoke personally with Talabani, President Massoud Barzani of the Kurdistan Regional Government, and Allawi (but not al-Maliki, notably).

The Washington Times revealed that Obama personally asked both Talabani and Barzani to cede the presidency to Allawi, a request that the Kurdish leaders flatly rejected. "And for the United States to be leaning on us, as they are now, in effect handpicking the new leaders of Iraq, is not respectful of Iraq's parliamentary system and touches on all of the insecurities of the Kurds, that the United States will once again betray us," Qubad Talabani, Jalal's son and the KRG's representative in Washington, told the Washington Times.

The senior administration official confirmed that Obama had floated the idea to the Kurds, but said it was only one of the various permutations put forth in the hope of convincing Allawi to join the new government.

"In the case of Iraqiya and Dr. Allawi, one of the things they had been saying for some time was an interest in the presidency after they gave up on what they believed was their right to be prime minister, which was a significant compromise by them," the official said. "And so we've had conversations, many of us, with Iraqis, exploring all of these different options. And one of the options certainly was for the Kurds to think about taking a position other than the presidency, which would have opened the presidency for Dr. Allawi."

Iraq experts praised the administration's efforts in the last few months of the negotiations, but lamented that it didn't always take into account the red lines of the parties, such as the Kurds.

"The level of U.S. engagement was not satisfactory in the early months of government formation, there was a sense of a hands-off approach. But by late summer, there was a clear sense of a need for more senior involvement," said Marisa Cochrane Sullivan, managing director at the Institute for the Study of War.

"As the months went on, a number of Iraqis were requesting Washington take a larger role to help bring people together," she said. "I'm glad to see now that there does seem to be engagement at the most senior levels, although Biden's office has been engaged all along."

Sullivan criticized the tactic of asking the Kurds to give up the presidency, however, saying that the White House should have known that was a non-starter.

"By the time the White House asked Talabani to step down, the Kurds had already publicly stated they wanted to maintain the presidency and that made it impossible for Talabani to do what Obama wanted," she said.

Some analysts hailed the administration's attempt to retain as much influence in Baghdad as possible, contrasting it with the supposedly more laissez-faire approach of former U.S. Ambassador to Iraq Chris Hill.

"The Obama administration also deserves some props for finally getting down to business in Baghdad with a new ambassador focused on forming a government, eschewing the more hands-off posture of his predecessor," said Max Boot, writing on the website of Commentary magazine.

The increasingly bitter Illinois Senate campaign between Republican Congressman Mark Kirk (R-IL) and the Democratic contender, Alexi Giannoulias, spilled over into foreign policy this week, as the chairman of the House Foreign Affairs Committee Howard Berman (D-CA) accused Kirk of exaggerating his role in crafting the Iran sanctions law. But who's really spinning the history of the bill for political gain?

Alluding to Kirk's previous misrepresentations about his military service, the Chicago Sun Times broke the story Monday with an article entitled, "Another Mark Kirk 'exaggeration'?" complete with a video of Kirk claiming credit for being a driving force behind what eventually became the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010, which President Obama signed into law in July.

"The Iran Sanctions Bill, it was originally Kirk-Andrews, but if you were going to move it, that means you need to adjust to the power of the House. This legislation eventually became Howard Berman's legislation," Kirk told the Sun Times.

The article then quoted Berman saying that his bill calling for petroleum sanctions against Iran had nothing to do with Kirk's previous bill calling for the exact same thing. "We didn't even look at his legislation at the time. Our bill did so much more and went so far beyond his bill, I would have to put it in the context of an exaggeration," Berman said.

Giannoulias, who enjoys Berman's support, called Kirk's claim that his bill was the framework for Berman's bill "egregious" and demanded an explanation.

But according to lawmakers, Congressional staffers, and outside groups who worked closely on the legislation, Kirk was in fact a key advocate for over four years of using gasoline and refined petroleum restrictions to pressure Iran to make concessions regarding its nuclear program.

In fact, Berman worked so closely with Kirk and others on the idea that media reports at the time acknowledged that Berman's Iran Refined Petroleum Sanctions Act, introduced in April 2009, borrowed language from related legislation introduced earlier by Kirk and Rep. Brad Sherman.

Even Democratic Congressional staffers gave Kirk credit for leading on the idea of petroleum sanction for Iran. They said that Berman's bill was clearly built off of Kirk's work, and criticized Berman for politicizing such a sensitive foreign policy issue.

"On this particular issue, Kirk has been a leader, if not the leader. When you talk about Iran petroleum sanctions, you talk about Mark Kirk," said one Democratic Hill staffer who worked on the bill.

"I'm all for a Democrat winning that seat, but this is not the way to do it," the staffer said. "It hurts our standing as Democrats in the pro-Israel community, because when you go to the pro-Israel community and say to them that Kirk didn't play a leading role, it just makes it hard to believe the next statement that comes out of our mouths."

Others who followed the progression of the Iran sanctions legislation closely also credited Kirk with a long history of leadership on this issue.

"There's no question that Mark Kirk was one of the first, if not the first member of Congress to advocate restricting the flow of gasoline to Iran as a way of pressuring Iran on its nuclear program," said Josh Block, who was the chief spokesman for the American Israel Public Affairs Committee, which was intimately involved in the bill's legislative journey.

Block, who now runs a strategic communications firm with Democratic consultant Lanny Davis, said that, after years of building momentum on various versions of Kirk's proposal, the decision was made to transfer ownership of the bill to Berman in order to allow it to garner a vote and pass with leadership support.

"There was a progression of bills that all did virtually identical things," Block said, explaining that this is a normal and commonplace legislative strategy and that Berman does deserve credit for aiding in the final push.

Kirk started his formal advocacy for the petroleum sanctions idea in 2005, when he founded the Iran Working Group, a congressional group that gathered information on sanctions options. In June 2005, he and Rep. Rob Andrews first introduced a resolution calling for restrictions of gasoline to Iran (H.Con.Res.177). In June 2006, they introduced that resolution again (H.Con.Res.425).

In June 2007, Kirk and Andrews introduced a more comprehensive bill, called the Iran Sanctions Enhancement Act, which included restrictions on the importation of refined petroleum (H.R. 2880). In April 2009, after Obama took office, Andrews got cold feet so Kirk moved forward with Sherman and introduced the Iran Diplomatic Enhancement Act (H.R. 1985).

When Berman introduced his Iran Refined Petroleum Sanctions Act at the end of April 2009, its original cosponsors included Kirk, as well as Andrews, Sherman, Rep. Ileana Ros-Lehtinen and others. When the bill passed the House in December 2009, Berman didn't object when Kirk said on the House floor that he and Andrews were "the two grandfathers of this bill and its policy."

Kirk's staffers point out that Berman has a history of cooperating well with Kirk in non-election years and then turning on him when the campaign starts. For example, Berman stumped for Kirk's opponent when Kirk first ran for an open seat in 2000 and then again endorsed his opponent in 2008. Still, they lament that years of cooperation on Iran have been reduced to a war of words over who gets credit.

"This is a desperate move by a desperate candidate with no foreign policy chops of his own," Kirk spokesman Richard Goldberg said about Giannoulias' efforts to make an issue of the Iran bill. "With no record to stand on, Alexi Giannoulias recruited someone with a history of hyper-partisan behavior just before an election to contradict his own previous statements when the legislation passed and level untruths against a well-established leader on the issue of Iran sanctions."

Berman's office did not respond to requests for comment.

President Obama delivered his second speech at the United Nations Thursday morning, giving a full-throated defense of his first 20 months in office and a sober assessment of the challenges that lie ahead.

He pled for the world to aggressively support the U.S.-led direct peace negotiations between the Israeli government and the Palestinian Authority. Specifically, he called on Arab nations to demonstrate their support through changes in policy that could help repair relations between Israel and its neighbors.

"Many in this hall count themselves as friends of the Palestinians. But these pledges must now be supported by deeds," Obama said. "Those who have signed on to the Arab Peace Initiative should seize this opportunity to make it real by taking tangible steps toward the normalization that it promises Israel. Those who speak out for Palestinian self-government should help the Palestinian Authority politically and financially, and - in so doing - help the Palestinians build the institutions of their state. And those who long to see an independent Palestine rise must stop trying to tear Israel down."

Obama also announced that he will add Indonesia, a country to which he has twice cancelled visits, to his Asia trip this November, which will also include stops in India, South Korea, and Japan. Obama meets with leaders from all 10 ASEAN member countries Friday.

And we made the G-20 the focal point for international coordination, because in a world where prosperity is more diffuse, we must broaden our circle of cooperation to include emerging economies.

There is much to show for our efforts, even as there is much more work to be done. The global economy has been pulled back from the brink of a depression, and is growing once more. We have resisted protectionism, and are exploring ways to expand trade and commerce among nations. But we cannot - and will not - rest until these seeds of progress grow into a broader prosperity, for all Americans, and for people around the globe.

On the war against Islamic extremists:

While drawing down in Iraq, we have refocused on defeating al Qaeda and denying its affiliates a safe-haven. In Afghanistan, the United States and our allies are pursuing a strategy to break the Taliban's momentum and build the capacity of Afghanistan's government and Security Forces, so that a transition to Afghan responsibility can begin next July. And from South Asia to the Horn of Africa, we are moving toward a more targeted approach- one that strengthens our partners, and dismantles terrorist networks without deploying large American armies.

On Iran:

As part of our efforts on non-proliferation, I offered the Islamic Republic of Iran an extended hand last year, and underscored that it has both rights and responsibilities as a member of the international community. I also said - in this hall - that Iran must be held accountable if it failed to meet those responsibilities. That is what we have done. Iran is the only party to the NPT that cannot demonstrate the peaceful intentions of its nuclear program, and those actions have consequences. Through UN Security Council Resolution 1929, we made it clear that international law is not an empty promise.

Now let me be clear once more: the United States and the international community seek a resolution to our differences with Iran, and the door remains open to diplomacy should Iran choose to walk through it. But the Iranian government must demonstrate a clear and credible commitment, and confirm to the world the peaceful intent of its nuclear program.

On the Middle East peace process:

Now, many are pessimistic about this process. The cynics say that Israelis and Palestinians are too distrustful of each other, and too divided internally, to forge lasting peace. Rejectionists on both sides will try to disrupt the process, with bitter words and with bombs. Some say that the gaps between the parties are too big; the potential for talks to break down is too great; and that after decades of failure, peace is simply not possible.

But consider the alternative. If an agreement is not reached, Palestinians will never know the pride and dignity that comes with their own state. Israelis will never know the certainty and security that comes with sovereign and stable neighbors who are committed to co-existence. The hard realities of demography will take hold. More blood will be shed. This Holy Land will remain a symbol of our differences, instead of our common humanity. 

I refuse to accept that future. We all have a choice to make. And each of us must choose the path of peace. That responsibility begins with the parties themselves, who must answer the call of history.

On human rights and democracy:

In times of economic unease, there can also be an anxiety about human rights. Today, as in past times of economic downturn, some put human rights aside for the promise of short term stability, or the false notion that economic growth can come at the expense of freedom. We see leaders abolishing term limits, crackdowns on civil society, and corruption smothering entrepreneurship and good governance. We see democratic reforms deferred indefinitely.

As I said last year, each country will pursue a path rooted in the culture of its people. Yet experience shows us that history is on the side of liberty - that the strongest foundation for human progress lies in open economies, open societies, and open governments. To put it simply: democracy, more than any other form of government, delivers for our citizens. And that truth will only grow stronger in a world where the borders between nations are blurred. 

It's time for every member state to open its elections to international monitors, and to increase the UN Democracy Fund. It's time to reinvigorate UN peacekeeping, so that missions have the resources necessary to succeed, and so atrocities like sexual violence are prevented and justice is enforced - because neither dignity nor democracy can thrive without basic security. And it's time to make this institution more accountable as well, because the challenges of a new century demand new ways of serving our common interests.

The world that America seeks is not one that we can build on our own. For human rights to reach those who suffer the boot of oppression, we need your voices to speak out. In particular, I appeal to those nations who emerged from tyranny and inspired the world in the second half of the last century - from South Africa to South Asia; from Eastern Europe to South America. Do not stand idly by when dissidents everywhere are imprisoned and protesters are beaten. Because part of the price of our own freedom is standing up for the freedom of others.

The State Department is pushing back against assertions that it signaled its agreement to the release of convicted PanAm Flight 103 bomber Abdelbasset al-Megrahi last year, only to strongly criticize that very release now.

In a rare publication of a diplomatic letter, State is hoping to combat the narrative of its involvement in the Megrahi affair as told in this July 25 article in the Times of London newspaper, headlined, "Revealed: Document exposes US double-talk on Lockerbie."

The Times story quotes from a letter from Richard LeBaron, deputy head of the U.S. Embassy in London, to Scottish First Minister Alex Salmond, expressing the U.S. position on the potential release of Megrahi on compassionate grounds due to his impending death from cancer.

According to the Times, the letter shows that the U.S. preferred to have Megrahi released rather than see him transferred to a prison in Libya. The U.S. government refused to permit the Scottish authorities to publish the letter, arguing it would prevent "frank and open communications" with other governments, according to the paper.

But that concern was outweighed by State's desire to set the record straight, as the department released the full text of the Aug. 21, 2009, letter today. State's aim is to show that the U.S. position was that Megrahi should stay in Scotland one way or the other, rather than return to Libya -- where he received a hero's welcome and remains to this day.

First, LeBaron did say that compassionate release was preferable to prisoner transfer:

"The United States is not prepared to support Megrahi's release on compassionate release or bail," Lebaron wrote. "Nevertheless, if Scottish authorities come to the conclusion that Megrahi must be released from Scottish custody, the U.S. position is that conditional release on compassionate grounds would be a far preferable alternative to prisoner transfer, which we strongly oppose."

But he also made clear that Megrahi had better be close to death:

"[A]ny such release should only come after the results of independent and comprehensive medical exams clearly establishing that Megrahi's life expectancy is less than three months. The results of these exams should be made available to the United States and the families of the victims of Pan Am 103. The justification of releasing Megrahi on compassionate grounds would be more severely undercut the longer he is free before his actual death," he said.

And the letter also states clearly that if released, the State Department wants Megrahi to stay in Scotland:

"[T]he United States would strongly oppose any release that would permit Megrahi to travel outside of Scotland. We believe that the welcoming reception that Megrahi might receive if he is permitted to travel abroad would be extremely inappropriate given Megrahi's conviction for a heinous crime that continues to have a deep and profound impact on so many. As such, compassionate release or bail should be conditioned on Megrahi remaining in Scotland," the letter states.

"To avoid the worst possible outcome -- a hero's welcome for Megrahi in Libya -- we indicated to Scottish authorities that, though we did not endorse Megrahi's early release under any scenario, compassionate release conditioned on Megrahi remaining under close supervision in Scotland would be less objectionable than any release permitting his travel outside of Scotland," the office of State Department spokesman P.J. Crowley said in a statement. "Unfortunately, the Scottish government did not heed those views."

Meanwhile, it appears that British Prime Minister David Cameron will not compel former British officials to appear at this week's Senate hearing on the issue, despite pleas from four senators.

As the clock winds down on President Obama's year-end deadline for Iran to respond to his efforts at engagement, Congress is preparing to pass language restricting U.S. loans that aid the Islamic Republic's oil industry.

The policy language is part of the fiscal 2010 state and foreign operations appropriations bill, which is moving on the Hill as part of a mammoth catch-all spending bill that's expected to move through both chambers this month. The bill would prevent the Export-Import Bank of the United States "from providing credit, insurance, or guarantees to any project controlled by any energy producers or refiners that contribute significantly to Iran's refined petroleum resources," according to a summary document.

It's been more than a month since the new fiscal year started and several federal agencies are operating under a stop-gap funding measure called a "continuing resolution" that keeps the government humming but doesn't allow for new funding initiatives to begin. That expires on Dec. 18, giving a semi-firm deadline for Congress to pass the real funding bills.

Democrats had promised not to resort to using such sloppy means of doling out appropriations, as was the usual practice in the Bush administration. But they got hampered by other priorities and the GOP stalled the process further by making issues out of things like funding for prisoners being transferred from Guantánamo Bay, Cuba.

Overall, the state and foreign ops funding would be $48.8 billion of discretionary budget authority for fiscal year 2010, $3.3 billion below the president's request. That's also about $1.2 billion less than what was given in fiscal 2009 including supplemental bills. A fiscal 2010 supplemental is widely expected.

Sources tell The Cable that for fiscal 2011 the administration request will be about 11 percent above that level, or at least that's the number decided on by the White House Office of Management and Budget, subject to further ongoing negotiations. OMB declined to comment.

Here are some of the other highlights in the bill:

  • Diplomatic and Consular Programs: $8.227 billion, $1.164 billion above 2009 and $733 million below the request, for diplomatic operations and to hire more than 700 new Foreign Service personnel
  • Operating Expenses for USAID: $1.39 billion, $330 million above 2009 and $50 million below the request, to allow USAID to hire 300 additional Foreign Service Officers as part of the Development Leadership Initiative (DLI)
  • Assistance for Afghanistan: $2.611 billion, $4 million below the 2009 enacted level including supplemental appropriations and $151 million below the request;
  • Assistance for Pakistan: $1.459 billion, $17.5 million above the 2009 enacted level including supplemental appropriations and $123.5 million below the request; and
  • Assistance for Iraq: $467 million, $142 million below the request
  • Assistance for Israel: $2.220 billion, which combined with the $555 million of forward funding in the 2009 supplemental is the same as the $2.775 billion in the request
  • Assistance for Egypt: $1.295 billion in economic and security assistance, which when combined with the $260 million in forward funding in the 2009 supplemental is the same as the request
  • Assistance for Jordan: $543 million in economic and security assistance, which when combined with the $150 million in forward funding in the 2009 supplemental is the same as the request
  • Assistance for Mexico: $231.6 million, which when combined with $254 million in forward funding for Mexico in the 2009 supplemental, results in a total of $485.6 million for bilateral programs for counternarcotics, law enforcement, and development assistance programs
  • Assistance for Central America: $83 million for regional security and law enforcement programs with the countries of Central America
  • Assistance for the Caribbean: $37 million for a new Caribbean Basin Security Initiative, which seeks to achieve security and prosperity in the region
  • Assistance for Colombia: $522 million
  • HIV/AIDS: $5.709 billion (including $350 million for AUSAID HIV/AIDS programs), $200 million above 2009 and $100 million above the request, for international HIV/AIDS prevention, treatment and care programs including $750 million for multilateral programs through the Global Fund to Fight HIV/AIDS, Tuberculosis and Malaria
  • USAID Global Health and Child Survival Programs: $2.42 billion to USAID, including for HIV/AIDS, which when combined with $50 million for global pandemic programs in the FY 2009 supplemental is $134 million above the request and $440 million above 2009, for other global health programs
